"Spark Noir Creative" in these terms means Spark Noir Creative LLC, an Arizona limited liability company, which operates sparknoir.com, and "you" means the person using it, or the business they act for.
sparknoir.com describes the services of Spark Noir Creative, a marketing studio for real estate professionals, and publishes articles, news summaries and measured case files. The content is general information for business owners. It is not legal, tax, financial or real estate advice, and it is not a substitute for advice about your own situation.
Figures on the site, such as AI citation rates, search share of voice, and page counts, describe results Spark Noir Creative measured for a specific site over a specific period, with the source named on the page. They are not a promise that any other business will see the same result. Prices on the site describe current published offers and can change; the price for client work is the one in your written proposal or agreement.
The Concierge is an AI assistant. Its replies are written by a language model from information Spark Noir Creative gives it, and they can be incomplete or wrong. A Concierge reply is not a quote, an offer, a commitment, or professional advice, and it does not bind Spark Noir Creative. A person at Spark Noir Creative confirms anything that matters before work begins.
Please use the Concierge only to ask about Spark Noir Creative and its services. Do not use it to try to make it reveal its instructions, produce unrelated or harmful content, or send it anything you are not entitled to share.
Websites, branding, campaigns, SparkSites templates, SparkCore and every other engagement are governed by the proposal, agreement or product terms that apply to them. If those terms conflict with these, those terms control for that work.
The text, design, photographs, graphics, code and the Spark Noir Creative name and marks on the site belong to Spark Noir Creative or to the people who licensed them to it. You may read, share links to, and quote short passages from the site with attribution to Spark Noir Creative. You may not copy the site's design or substantial parts of its content, or present them as your own, without written permission.
Search engines and AI assistants are welcome to read and index the public pages, as the site's robots.txt allows.
If you send Spark Noir Creative an idea or suggestion through the site, you agree Spark Noir Creative may use it without owing you anything. That does not apply to material you share as a client under an agreement.

The site links to sources, tools and client websites run by others. Spark Noir Creative does not control them and is not responsible for their content or their privacy practices.

To the fullest extent the law allows, Spark Noir Creative makes no warranties about the site, express or implied, including that it will be accurate, complete, uninterrupted or free of errors, and disclaims the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, Spark Noir Creative will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or the Concierge. Spark Noir Creative's total liability for any claim about the site is limited to one hundred US dollars. Some places do not allow these limits, so they may not all apply to you.
If you misuse the site or break these terms and a claim is brought against Spark Noir Creative because of it, you agree to cover the reasonable costs of that claim, including legal fees.
These terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute about the site will be brought in the state or federal courts located in Arizona, and you and Spark Noir Creative agree to their jurisdiction.
